These Terms of Service ("Terms") establish the legally binding agreement between you ("Client," "you," or "your") and DiPilla Aesthetics ("we," "us," "our," or "Company"). By accessing our website, scheduling a consultation, booking a treatment, or using our services in any way, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

1. Acceptance of Terms
By using the DiPilla Aesthetics website and booking treatments, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy. We reserve the right to modify these Terms at any time. Continued use of our website and services following any modifications constitutes your acceptance of the updated Terms.
2. Services Offered
DiPilla Aesthetics offers professional aesthetic consultation, treatment, and skincare recommendations provided by licensed aestheticians and approved medical professionals. Our services include but are not limited to:
- Skin consultations and analysis
- Chemical exfoliation treatments
- Laser treatments and resurfacing
- Skincare recommendations and product sales
- Customized treatment planning
All treatments are performed by qualified professionals in compliance with applicable state and local regulations.
3. Eligibility and Good Faith Exam
To receive aesthetic treatments at DiPilla Aesthetics, you must:
- Be at least 18 years of age
- Be in good physical health and free from medical conditions that would contraindicate treatment
- Complete a required Good Faith Exam through Qualify, our third-party professional assessment partner, before beginning any treatments
- Provide accurate and truthful information about your medical history, current medications, and skin conditions
The Good Faith Exam is a mandatory 15-minute professional assessment conducted once per year and covers all treatments completed at DiPilla Aesthetics during that 12-month period. By proceeding with this exam and treatments, you confirm that you meet all eligibility requirements and authorize the sharing of relevant health information with our treatment providers.
4. Consultation and Treatment Booking
Scheduling: Appointments must be scheduled through our website, phone, or in person. We will make reasonable efforts to accommodate your preferred appointment time, but availability is not guaranteed.
Cancellation and Rescheduling:
- Cancellations or rescheduling must be made at least 24 hours in advance to avoid a cancellation fee
- Cancellations made less than 24 hours before your appointment will be subject to a cancellation fee of 50% of the service
- No-shows (failure to arrive for a scheduled appointment) will be charged in full
- We reserve the right to reschedule or cancel appointments due to emergency circumstances
Consultation Fee: Consultations may be subject to a fee of $50. This fee may be applied toward treatment costs if you proceed with booking or product purchases
5. Payment Terms
Payment Methods: We accept credit cards or exact cash. Payment is due at the time of service unless other arrangements have been made in advance.
Pricing: All prices are subject to change without notice. Pricing will be confirmed at the time of booking. Package pricing and promotional offers are valid only during specified promotional periods.
Refunds: Refunds are not available for completed treatments or purchased products. Unused package credits are non-refundable but may be transferred or carried forward for one month.
Late Payments: Accounts not paid within 10 days of service may be subject to late fees or collection action.
Membership cancellation: Must meet the minimum required commitment of months agreed upon with the initial contract. Written documentation is required 30 days before the date of cancellation.
6. Health and Safety Disclaimer
Medical Disclaimers:
- DiPilla Aesthetics does not provide medical advice. Our aestheticians are licensed professionals, not physicians. For medical concerns, please consult with a dermatologist or your healthcare provider.
- Results from aesthetic treatments vary by individual and are not guaranteed. Factors affecting results include skin type, age, overall health, lifestyle, sun exposure, and adherence to post-treatment care instructions.
- Some treatments may not be appropriate for certain skin conditions, medical histories, or medications. We will assess compatibility during your consultation.
Pregnancy and Nursing: Certain treatments are contraindicated during pregnancy and nursing. Please inform us if you are pregnant, nursing, or planning to become pregnant, as some treatments may need to be postponed.
Medical Conditions: Clients with certain medical conditions (including but not limited to active skin infections, severe eczema, open wounds, or immunocompromised conditions) may not be eligible for certain treatments. You are responsible for disclosing all relevant medical information.
Medications: Certain medications (including but not limited to Accutane, blood thinners, and photosensitizing medications) may contraindicate or complicate aesthetic treatments. Please provide a complete list of current medications during your consultation.
7. Pre-Treatment and Post-Treatment Responsibilities
Client Responsibilities:
- You are responsible for following all pre-treatment preparation instructions provided by DiPilla Aesthetics
- You are responsible for following all post-treatment care instructions to ensure optimal healing and results
- You must inform us of any unusual reactions, complications, or concerns during recovery
- You are responsible for protecting treated skin from sun exposure as instructed
- Failure to follow pre-treatment and post-treatment instructions may result in suboptimal results and is not the responsibility of DiPilla Aesthetics
Follow-Up Appointments: Many treatments require follow-up appointments for assessment and optimization. Follow-up appointments are strongly encouraged and may be included with your treatment. Failure to attend follow-up appointments may impact your results.
8. Assumption of Risk and Limitations of Liability
Risks of Treatment: While professional aesthetic treatments are generally safe when performed by qualified professionals, all medical and aesthetic procedures carry inherent risks, which may include but are not limited to:
- Temporary redness, swelling, or sensitivity
- Mild discomfort or pain
- Temporary changes in skin pigmentation
- Allergic reactions to products or treatments
- Infection (rare but possible)
- Scarring (rare)
- Prolonged healing or delayed results
By proceeding with any treatment, you acknowledge that you understand these risks and accept them.
Release of Liability: You hereby release and hold harmless DiPilla Aesthetics, Chelsea DiPilla, all staff members, including medical director, and our partners (including Qualify) from any and all claims, demands, or causes of action arising from or related to your treatments, including but not limited to claims of injury, dissatisfaction with results, or complications.
Limitation of Damages: To the maximum extent permitted by law, DiPilla Aesthetics' total liability to you shall not exceed the amount paid for the specific treatment or service that gave rise to the claim.
9. Contraindications and Exclusions
DiPilla Aesthetics reserves the right to refuse service or decline to treat any client if:
- You are not deemed a safe candidate for treatment based on the Good Faith Exam or consultation
- You have contraindications that make treatment inappropriate or dangerous
- You are under the influence of alcohol or drugs
- You are unable or unwilling to follow pre-treatment and post-treatment instructions
- Your behavior is disruptive, disrespectful, or threatening to staff or other clients
10. Skincare Product Sales
DiPilla Aesthetics recommends and sells medical-grade skincare products from carefully curated brands, including Alastin Skincare.
Product Guarantees: Product recommendations are based on professional assessment. Results vary by individual based on skin type, consistency of use, lifestyle, and other factors. Products are non-refundable once opened or used; unopened products may be returned within 10 days credit.
Ingredient Information: It is your responsibility to review product ingredients and inform us of any known allergies or sensitivities. We encourage you to perform a patch test before full application.
Cruelty-Free Commitment: All products recommended and sold by DiPilla Aesthetics are cruelty-free and have not been tested on animals.
11. Photography and Testimonials
Before and After Photos: DiPilla Aesthetics may request permission to photograph your skin before and after treatments for documentation, staff training, and educational purposes. Your consent is not required to receive treatment; however, photography helps us assess results and improve our services. Any before-and-after photos will be kept confidential and used only with your explicit written consent.
Testimonials: We may request permission to share your testimonial or review. You are under no obligation to provide a testimonial, and refusal will not affect your access to services.
12. Intellectual Property
All content on the DiPilla Aesthetics website, including text, images, graphics, logos, and videos, is the property of DiPilla Aesthetics or its content providers and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or transmit any content without our express written consent.
13. Limitation of Website Liability
"As-Is" Disclaimer: The DiPilla Aesthetics website is provided on an "as-is" basis without warranties of any kind, either express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

15. Dispute Resolution
Any disputes arising from these Terms or your use of DiPilla Aesthetics services shall be resolved through New Hanover County. You agree to submit to the jurisdiction of 165 Porter’s Neck Road, Unit 120, Ste. 4
Wilmington NC 28411 for the resolution of any disputes.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, along with our Privacy Policy and any other policies or agreements posted on our website, constitute the entire agreement between you and DiPilla Aesthetics regarding your use of our website and services.
18. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of North Carolina, without regard to its conflict of law principles.
